The short answer
An I-751 cover letter is an optional one- or two-page summary placed on top of your petition to remove conditions. It names the filing basis, lists every enclosed document by exhibit number and is signed by the filer. Affidavits are separate sworn statements from people who know your marriage first-hand.
At a glance
| Is a cover letter required? | No. It is optional but helps the officer find your evidence |
| Are affidavits required? | No. The instructions list them as one type of supporting evidence |
| How many affiants? | The instructions describe at least two people |
| Notarized? | Sworn or affirmed; a penalty-of-perjury statement is common |
| Current form edition | 04/01/24 |
This guide gives you an I-751 cover letter sample for a joint petition, a waiver version, three affidavit examples and a fill-in template. All names are fictional. For eligibility, filing steps and the full evidence list, start with our Form I-751 guide to removing conditions.
Every sample here is an example to adapt, not text to copy: write only what is true, and check the current Form I-751 instructions before you file.
What Is an I-751 Cover Letter?
An I-751 cover letter is a short, signed letter on top of a paper Form I-751 package. It tells the USCIS officer who is filing, on what basis, and which documents follow.
It works like a table of contents for the whole package.
What the letter does for the officer
A clear enclosure list lets an officer opening a removal of conditions package confirm in seconds that card copies, payment and marriage evidence are present.
It also helps you check nothing is missing.
What the letter cannot do
The cover letter is not evidence. Writing "our marriage is real" proves nothing. A letter makes good evidence easier to find; it cannot fix a thin file.
Put your effort into the exhibits.
Is a Cover Letter Required for Form I-751?
No. Neither the Form I-751 instructions nor the uscis.gov form page require a cover letter. USCIS accepts a signed petition with the right fee and evidence without one. Most paper filers add one anyway.
It costs nothing to include and takes minutes to write.
When a letter is worth writing
Write one when you mail a paper package, send many exhibits, or need a one-line explanation. Examples: a waiver filing, children in Part 5 or a late filing.
Keep that explanation brief.
When skipping it is fine
A paper filer with only a few clear documents can also skip it. Leaving it out never causes a rejection.
Online filers rarely need one, because the upload screens already sort each document by type.
Cover Letter vs Affidavit vs Personal Statement
A cover letter organizes the package. An affidavit is sworn testimony from a third party who knows your marriage. A personal statement is your own sworn account, used mainly in waiver cases.
Each one is explained below, with an example of when you need it.
How the documents compare
Each of the four documents has a different author and a different job, as the comparison shows.
| Document | Who writes it | Sworn? | Main job | Needed? |
|---|---|---|---|---|
| Cover letter | You (both spouses if joint) | No | Lists what is enclosed | Optional |
| Third-party affidavit | Friend, relative, neighbor, coworker | Yes | First-hand account of the marriage | Optional evidence |
| Personal statement | The conditional resident | Yes | Your own account | Common in waivers |
| Form I-751 | You (both spouses if joint) | Signed under penalty of perjury | The petition itself | Required |
Only the petition itself is required.
Which ones you write yourself
You write the cover letter and any personal statement. You must never write an affidavit for someone else to sign. You may hand an affiant the list of required details, but the account must be theirs.
What Goes in a Cover Letter for Form I-751?
A cover letter for Form I-751 needs seven parts: date, return address, USCIS address, a subject line with your A-Number, the filing basis, a numbered enclosure list and signatures. Anything extra should be one plain sentence about an unusual fact.

The seven building blocks
- Date and your mailing address
- The USCIS address from the official filing page
- A subject line naming the form, your name and A-Number
- One sentence on the filing basis (joint or waiver ground)
- A numbered enclosure list matching your tabs
- Optional: one note on anything unusual
- Signatures and printed names
Details to leave out
Skip your life story, opinions and legal citations. Do not repeat your full Social Security number, account numbers or children's medical details.
Those details add risk without adding proof, and anything sensitive can sit in the exhibits instead.
How Should You Format an I-751 Cover Letter?
Use plain business-letter format on single-sided letter-size paper, typed in an 11- or 12-point font. Keep it to one page if you can. Write in English, keep sentences short and sign in ink. In a joint filing, both spouses sign.
Page layout
Left-align everything: your address, the date, the USCIS address, then a bold subject line. Number exhibits with letters, and use the same labels on the tab dividers so the officer can match them.
Tone and length
Be polite and factual. "Please find enclosed" and "Thank you for your review" are enough. Skip words like "wonderful" or "deeply loving"; officers weigh documents, not adjectives.
One page is enough.
I-751 Cover Letter Sample: Joint Petition
This I-751 cover letter sample is for a fictional couple filing jointly in the 90-day window. Replace every bracket, delete exhibits you are not sending, and copy the USCIS address on the day you mail.
File in the 90 days before your 2-year card expires.
The sample letter
EXAMPLE ONLY: fictional couple. Adapt every line to your own facts.
Priya Raman and Daniel Okafor, [street, city, state ZIP]

Why this sample works
The subject line carries the form, basis and A-Number, so a loose page can be matched to the file. The first paragraph confirms timing. Each exhibit has one label and a date range, and no line claims more than the exhibits show.
How Do You Adapt the I-751 Cover Letter Sample to Your Evidence?
Keep the layout and swap the exhibits for the records you actually hold. Homeowners list the deed and mortgage statements instead of a lease. Parents list a child's birth certificate first, since it is strong proof. If one spouse changed names, write "Priya Raman (formerly Priya Iyer)" once, and copy A-Numbers from the card, not from memory.
Cover Letter Example for a Divorce Waiver
A waiver cover letter is signed only by the conditional resident. It names the waiver ground, puts proof that the marriage ended first, and still lists good-faith evidence from the years the marriage was intact.
Adapt it to your own facts.
Sample waiver letter
EXAMPLE ONLY: fictional filer. Change every detail.
Aiden Novak, [street, city, state ZIP]. [Date]. USCIS, [address from the "Where to File" page]
Re: Form I-751, request for waiver of the joint filing requirement. Petitioner: Aiden Novak, A[000-000-000]. Basis: good-faith marriage ended by divorce
Dear Officer: I am filing on my own and request a waiver of the joint filing requirement. My marriage to [former spouse] ended by a final decree dated [date]. Enclosed: (1) payment; (2) signed Form I-751; (3) copy of my card, front and back; (4) Exhibit A, certified final divorce decree; (5) Exhibit B, joint lease for [dates]; (6) Exhibit C, joint bank statements; (7) Exhibit D, my sworn personal statement; (8) Exhibit E, two affidavits from people who knew us as a couple.
[Signature] Aiden Novak
How Is a Waiver Cover Letter Different From a Joint One?
The subject line says "waiver," and the final divorce decree leads the exhibits. The personal statement matters more, because no spouse vouches for the marriage. Evidence still covers the time you lived together, so keep those exhibits in date order.

Cover Letter Wording for Other Waiver Bases
Each waiver ground changes the subject line and the lead exhibit; the layout stays the same. The instructions let waiver filers send the petition any time before removal.
you can file I-751 alone if your spouse died, you divorced, you were abused, or removal would cause extreme hardship. The examples below are fictional; adapt them carefully.
Death of a spouse
Subject: "Form I-751, waiver: spouse deceased." Opening: "My husband, [name], died on [date]. His death certificate is Exhibit A."
Follow it with shared-life evidence from the years you were together, such as a joint lease, bank records and photos, so the officer sees the marriage was genuine.
Battery or extreme cruelty
Subject: "Form I-751, waiver: battery or extreme cruelty." Keep the letter short; let police reports, protection orders and your statement carry the detail. G-1055 lists $750 (paper) / $700 (online), with $0 for abuse waiver filers.
Extreme hardship
Subject: "Form I-751, waiver: extreme hardship." Name the hardship in one sentence and list the proof. The instructions say the evidence must relate to factors that arose during the two-year conditional period, so date every exhibit.
How Do You List Children in an I-751 Cover Letter?
Add each child who got conditional status through the same marriage under the subject line, with their A-Numbers. The instructions let you include children who got status on the same day as you or within 90 days after.
Check each child's card.
Adding children to the letter
Add one line: "Included children: [Name], A[000-000-000]; [Name], A[000-000-000]." Put the children's card copies next to your own so all identity documents sit together at the front.
Each child also needs card copies.
Does a Child Filing Separately Need Their Own Cover Letter?
Yes. A child who got status later, or who must file alone, needs a separate Form I-751 and fee. Write a separate letter for that package and mention the parent's receipt number if you have it. Label that child's exhibits on their own so the two files are not mixed.
How Do You Build an Exhibit Index?
An exhibit index is your enclosure list as a small table: exhibit letter, document, period covered and page count. Put it on page two of the letter or right after it.
Keep the letters in the same order as the stack, and recount pages after any last change.
A sample exhibit index
This fictional example shows how a joint package might lay out its six exhibits in order.
| Exhibit | Document | Covers | Pages |
|---|---|---|---|
| A | Joint lease and renewal | [Month/year] to present | 6 |
| B | Joint bank statements | 12 sample months | 12 |
| C | Joint tax return transcripts | [Two tax years] | 8 |
| D | Insurance listing spouse | Current policy | 2 |
| E | Photographs with captions | Both years | 4 |
| F | Two sworn affidavits | Written [month/year] | 4 |
Labeling the tabs
Use paper separator pages marked "Exhibit A," "Exhibit B" and so on. Skip binders and staples; one clip per exhibit is enough.
Write the exhibit letter in the top corner.
What Is an I-751 Affidavit?
An I-751 affidavit is a sworn or affirmed statement from someone with personal knowledge of your marriage. The Form I-751 instructions list affidavits from at least two people who have known both of you since conditional residence began as one type of good-faith evidence.
Affiants may be asked to testify
The instructions warn that affiants may be required to testify before an officer about what they wrote. Each writer should sign only what they can repeat.
Tell each writer this before they sign.
What Must an I-751 Affidavit Include?
The instructions (edition 04/01/24) say the original affidavit must be sent. It must give the writer's full name and address, date and place of birth, relationship to you or your spouse, and full details of how they know about your marriage. Affidavits must be backed by other evidence.

Who Should Write an Affidavit for Your I-751?
The best affiants have seen your marriage often during the two-year period and can describe specific events with dates. Close friends, neighbors, coworkers, landlords and relatives qualify. Someone who met you once at the wedding adds little.
Choose quality over status.
Strong affiant choices
- A friend who visits often and remembers dates
- A neighbor who sees you both every week
- A landlord who rented to both of you
- A relative of the citizen spouse who hosts holidays
Weak affiant choices
People who know only one spouse, online acquaintances or anyone paid to write add little. A writer who only heard about your marriage secondhand fails the personal-knowledge test.
Choose people instead who saw you both.
How Many Affidavits Should You Include?
The I-751 instructions describe affidavits from at least two people. Two to four strong affidavits are typical. Two specific, first-hand accounts outweigh ten short letters that only say "they are a lovely couple."
Quality matters most: detail and dates beat sheer numbers.

Covering different parts of your life
Pick writers who see different sides of the marriage: one from the citizen spouse's family, one from your neighborhood or workplace.
Different viewpoints make the accounts harder to dismiss as rehearsed and show the marriage in more than one setting.
Why more is not always better
Ten near-identical letters suggest the couple drafted them. Add extra affidavits mainly when your joint documents are thin.
Two strong letters that describe different events usually do more than a stack of similar ones, so choose writers who each saw something new.
Do I-751 Affidavits Need to Be Notarized?
The instructions say affidavits must be "sworn to or affirmed" but do not use the word notarized. Many filers use a notary to remove doubt. Others end with a signed penalty-of-perjury statement. Either way, the affiant signs the original in ink.
Using a notary
A notarized affidavit is signed before a notary, who stamps it. Overseas writers can use a local notary or a U.S. consulate, plus a certified translation.
A notary checks identity, not the content.
A penalty-of-perjury closing
Without a notary, many writers end with: "I declare under penalty of perjury under the laws of the United States of America that the foregoing is true and correct," then sign, print their name and date it.
Affidavit Sample for I-751: A Friend
This affidavit sample for I-751 comes from a fictional close friend. It shows the required identity details, how she met each spouse and dated events across the marriage.
All names and details are fictional. Adapt the structure, not the wording; your affiant must write their own account.
The sample affidavit
EXAMPLE ONLY: fictional affiant. Your affiant must write a true account.
Affidavit of Teresa Lindqvist in support of Form I-751 for Priya Raman and Daniel Okafor
I, Teresa Lindqvist, born [date] in [city, country], living at [full address], state the following from personal knowledge. I have known Daniel since [year], when we worked together at [employer]. I met Priya in [month/year] and attended their wedding on [date].
Since the wedding I have visited their apartment about once a month. I helped them move in [month/year]. After my surgery in [month/year], Priya drove me to follow-up visits. I have no financial interest in this petition.
I declare under penalty of perjury under the laws of the United States of America that the foregoing is true and correct. [Signature, date, phone]
Notes on this example
She explains how she met each spouse, gives months and places, and states only what she saw. About 150 words is enough when every sentence carries a fact.
She also signs and dates it.
I-751 Affidavit Example: A Family Member
Relatives may write affidavits; the instructions ask each writer to state their relationship to you or your spouse. A relative's account helps most when it describes events they attended, not general approval of the match.
Names, dates and places here are fictional.
Sample from a mother-in-law
EXAMPLE ONLY: fictional affiant.
I, Rosa Okafor, born [date] in [city], living at [address], am Daniel Okafor's mother. I met Priya Raman in [month/year] at a dinner in my home. Priya and Daniel spent Thanksgiving [years] at my house. After my fall in [month/year], they took turns staying with me for two weeks, and Priya set up my medication schedule. I declare under penalty of perjury that this is true and correct. [Signature, date]
Notes on relatives as affiants
Officers expect family to be supportive, so concrete detail matters even more. Pair it with one from a non-relative.
A parent or sibling who describes holidays, visits to the couple's home or help during a move gives the officer events to verify.
Affidavit Letter Example From a Coworker or Neighbor
A short affidavit from a neighbor or coworker adds an outside view of daily life. Three or four specific observations, the required identity details and a sworn closing make a useful i 751 affidavit letter example.
All details are fictional.
Short neighbor sample
EXAMPLE ONLY: fictional affiant. I, Marcus Bell, born [date] in [city], have lived at [address], next door to Priya Raman and Daniel Okafor, since [month/year]. I see them leave for work together most weekdays. They watered my plants in [month/year] and invited me to Daniel's birthday dinner on [date]. I declare under penalty of perjury that the statements in this letter are true and correct. [Signature, date]
When an outside view helps most
It helps when a couple has few joint documents, such as newlyweds who kept separate accounts. A neighbor or landlord can confirm a shared home; a coworker can confirm both spouses attend work events.
I-751 Affidavit Letter Template (Fill-in Version)
Use this I-751 affidavit letter template as a checklist for your affiant, not finished text. It follows the details the instructions require.
affidavits from at least two people who have known you both since conditional residence began can support the I-751. The affiant should replace each bracket with true details and write the events in their own words.
Fill-in template
TEMPLATE: for the affiant to complete in their own words.
- I, [full name], was born on [date] in [city, country] and live at [full address].
- My relationship to [spouse 1] / [spouse 2] is: [friend, neighbor, relative, coworker].
- I met [spouse 1] in [month/year] at [place], and [spouse 2] in [month/year] at [place].
- I know about their marriage because: [how often you see them, and where].
- Events I attended or saw: [event, date, place]; [event, date, place].
- I declare under penalty of perjury under the laws of the United States of America that the foregoing statements are true and correct.
[Signature] [Printed name] [Date] [Phone or email]
Filling in the brackets
Each bracket becomes a fact the writer knows first-hand; if they cannot fill a line honestly, they delete it. This is the backbone of an i 751 affidavit letter of support template, but no two writers should send matching wording.
What Makes an I-751 Affidavit Strong or Weak?
A strong affidavit gives specific, dated, first-hand events from across the conditional period, in the writer's own words. A weak one praises the couple in general terms, repeats a template or describes things the writer only heard about.
Examples follow below.

Side-by-side wording
Each weak line on the left makes a claim; each stronger line gives a dated event the officer could check.
| Weak sentence | Stronger sentence |
|---|---|
| "They are very much in love." | "On [date] they hosted six of us and cooked together." |
| "I know they live together." | "I have visited their apartment on [street] about ten times." |
Details that add weight
Repeated contact, shared routines and a family emergency handled together all carry weight.
So do events the writer attended in person, such as a holiday dinner, a hospital visit or help with a move, described with a month, a place and who was there.
How Should an Affiant Write in Their Own Words?
Give the affiant the required details and a few prompt questions, then let them write freely. You may check the draft for missing identity details, but never rewrite their account or add events they did not see.
Keep it honest.

Prompt questions to share
- When and where did you meet each of us?
- How often do you see us, and where?
- Which trips, holidays or events have we shared?
- What did you notice when you visited our home?
Can an I-751 Affidavit Be Written in Another Language?
Yes. The writer can use their own language, which often reads more naturally. Send the original plus a full English translation. The instructions require the translator to certify it is complete and accurate, and to sign with their printed name, date and contact details.
Is an "Affidavit of Support" Part of the I-751?
No. People searching for a sample letter affidavit of support i 751 usually mean a letter supporting the marriage, not Form I-864. The I-751 does not require an I-864, which belongs to the earlier green card stage.
Do not send one.
Not Form I-864
Form I-864 is a binding financial promise filed with the green card application. Our Form I-864 affidavit of support guide explains when it applies.
The obligation it created usually continues while you are a conditional resident.
Naming your letters clearly
Title third-party letters "Affidavit in support of Form I-751" rather than "affidavit of support." That small change keeps the officer from looking for a missing financial form.
It also avoids confusion.
Personal Statements for Waiver Filers
A personal statement is the conditional resident's own sworn account of how the marriage began, the life you shared and, in waivers, how it ended. It is optional for joint filers but often central for waiver filers.
Sign it under penalty of perjury.
What a statement covers
Walk through dates in order: meeting, marriage, homes, shared finances and, if it ended, why. Tie each claim to an exhibit.
Keep the tone factual, and let the documents carry the weight instead of strong adjectives.
Sample opening paragraph
EXAMPLE ONLY: fictional filer. "I, Aiden Novak, state the following under penalty of perjury. I met [former spouse] in [month/year] at [place]. We married on [date] and moved to [address] (Exhibit B). We opened a joint account in [month/year] (Exhibit C). We separated on [date]."
What Evidence Should an I-751 Cover Letter Point To?
Point to evidence that the marriage was real from the wedding to the filing date. The instructions mention joint leases or mortgages, financial records, tax returns, insurance, children's birth certificates and affidavits.
Cover the whole period, not only the wedding.

Evidence across the whole period
Pick samples from the start, middle and end of the two years rather than every page of one month. A lease plus its renewal and statements from several quarters show continuity.
Financial vs shared-life evidence
Financial evidence shows shared responsibility: accounts, loans, insurance, taxes. Shared-life evidence shows the relationship: dated photos, trips and cards.
Strong packages mix both types, and the cover letter should point to each one by its exhibit letter.
Can You Get an I-751 Cover Letter PDF?
USCIS does not publish an official I-751 cover letter PDF, and none is required. Type your own letter from the samples here, print and sign it, and save a signed scan as a PDF for online use.
Keep a copy too.
No official version exists
A cover letter is not a USCIS form, so it has no edition date and no required wording. Sites charging for an i 751 cover letter pdf sell formatting only. Our guide to spotting USCIS scams lists other warning signs.
Saving your letter as a PDF
Use "Save as PDF" in any word processor, then print and sign. Scan the signed copy and name it clearly, such as "Cover-letter-Raman-I-751.pdf."
Keep the original signed paper copy at home.
Do You Need a Cover Letter if You File the I-751 Online?
Usually not. Online filing sorts uploads into evidence categories, which does the job of an enclosure list. You can still upload a short signed explanation if something needs context, such as a name change.
Keep that note brief and factual.
How online uploads differ
Sign up at myaccount.uscis.gov/create-account and choose the I-751. Name each file descriptively. Our page on the USCIS online account shows where notices appear after you submit.
Use clear, readable PDF files.
Explanation notes online
Title a short note "Explanation regarding [topic]," sign it and upload it with the related evidence. Keep it to a few plain sentences.
Point to the exhibit that supports it.
How Do You Assemble a Paper I-751 Package?
Put the cover letter on top, then payment, the signed petition, card copies and exhibits in the letter's order. Original affidavits usually go last. Keep a full copy before you mail it.
Use binder clips, not staples, so pages scan cleanly.

A sample stacking order
This example order matches the cover letter and exhibit index, from top to bottom:
- Cover letter and exhibit index
- Payment form
- Form I-751, signed
- Card copies, front and back
- Exhibits with separator pages
- Original affidavits and translations
Copies vs originals
The instructions say to send legible photocopies unless an original is requested; affidavits are the exception. Never mail your only marriage certificate or divorce decree.
Keep the originals safe at home.
Where Should You Mail the I-751 Package?
Mail it to the address on the uscis.gov "Where to File" page for Form I-751, which depends on your state and basis. Check it on the day you mail, and use a trackable delivery service so you can show when the package arrived.
Checking the address on filing day
USCIS moves addresses from time to time; for many other forms it announced New USCIS mailing addresses from Oct. 7, 2026; old addresses accepted if postmarked by Nov. 9, 2026.
Mailing inside the 90-day window
The timing rule for joint filers: File in the 90 days before your 2-year card expires. A joint package mailed earlier may be returned, so date your cover letter and mail the package inside that window.
How Much Does It Cost to File Form I-751?
As of October 2026, the fee is $750 (paper) / $700 (online) under Form G-1055. Pay the exact amount for the version you file, and list the payment as the first enclosure in your cover letter.
Check the fee again before you mail.
Fee and payment summary
USCIS fees are nonrefundable, even if your case is denied or withdrawn. Some filers qualify for a USCIS fee waiver. For how this fee fits the wider budget, see our breakdown of green card fees.
Explaining Gaps or Unusual Facts in the Letter
Use one or two sentences to flag an unusual fact and point to the exhibit that explains it. Common examples are living apart, few joint accounts or a late filing. Never hide a gap; explain it honestly with proof.
Keep it short.
Living apart for work
EXAMPLE ONLY. "From [month/year] to [month/year], Daniel worked a contract in [city] while Priya kept our apartment. Exhibit G holds his employer letter, travel receipts and phone records."
Adapt the wording to your facts.
Few joint documents
EXAMPLE ONLY. "We keep separate accounts because [honest reason]. We split rent and bills, as the transfers in Exhibit B show, and both of us are on the lease in Exhibit A."
Filing after the 90-day window
EXAMPLE ONLY. "We are filing after Priya's card expired on [date] because [honest reason, such as a hospital stay]. Exhibit H holds [records showing the reason and dates]."
A late joint petition must explain the delay, and USCIS decides whether the reason is acceptable.
What Should You Never Put in a Cover Letter or Affidavit?
Never write anything false, inflated or unsupported, and never ask anyone to sign a statement they cannot confirm. False statements to USCIS can lead to denial, removal proceedings and criminal penalties.
If you are unsure whether something is accurate, leave it out.
False or inflated claims
Do not invent events, backdate documents or claim a shared home you did not share. USCIS can contact affiants and interview spouses separately, and inconsistencies damage even good cases.
Being truthful protects you and your affiants.
Legal arguments and pressure
A cover letter is not a legal brief. If your case needs a legal argument, as abuse waivers or criminal records often do, have an attorney or accredited representative prepare it.
Common Mistakes With I-751 Letters
The most common mistakes are naming the wrong petitioner, an enclosure list that does not match the tabs, photocopied affidavits and affidavits with identical wording. A final read against the stack catches nearly all of them.
Each one is easy to fix before you mail the package.

Cover letter mistakes
- Calling only the citizen spouse "the petitioner" in a joint filing
- Listing a document you forgot to include
- An old edition date in the subject line
- A wrong or missing A-Number
- Only one spouse signing a joint letter
Affidavit mistakes
Missing the writer's date or place of birth
No explanation of how they know each spouse
A photocopy instead of the signed original
Foreign-language text with no certified translation
Identical wording across several affidavits
What Happens After USCIS Receives Your I-751?
USCIS sends a Form I-797C receipt notice that extends your status, schedules biometrics, then reviews the file your letter organized. It may approve, send a Request for Evidence (RFE) or schedule an interview.
notify USCIS within 10 days of moving while your I-751 is pending.

Biometrics and review
Most filers attend a biometrics appointment weeks later. USCIS's data shows I-751: median 22.6 months (USCIS data, Apr.-June 2026); see our I-751 processing time guide for the live tool.
Keep your receipt notice safe.
How Long Does the I-751 Receipt Notice Extend Your Green Card?
Keep the receipt notice with your expired card, because together they prove status: I-751 receipt notice extends conditional status and work authorization for 48 months. Carry both when you travel. Our guide to the I-797C notice of action explains each field. The first online update is usually case was received.
What If You Get an RFE After Sending Affidavits?
An RFE means the officer needs more proof. Send everything requested in one package, with the RFE notice on top and a new response cover letter that answers each item in order. RFE deadline: up to 12 weeks (the exact date is on your RFE); no extensions.
Responding item by item
Number each requested item and the exhibit that answers it. New affidavits follow the same rules: originals, identity details, first-hand events. Our Request for Evidence guide covers format and deadlines.
When an RFE turns into a NOID
A Notice of Intent to Deny (NOID) is a serious step. Read our notice of intent to deny guide and consider legal help before you respond.
Note the response deadline.
If X, Do Y: Choosing the Right Letters
Use this table to decide which letters your situation calls for. If yours involves abuse, a criminal record or a pending divorce, get individual advice instead.
The examples are general guidance only. Each row names the documents that matter most; the order of the stack still follows your exhibit index.
Decision table
Find the row closest to your filing basis and use it as your starting list.
| If your situation is… | Then send… |
|---|---|
| Joint filing, strong joint documents | Short cover letter; affidavits optional |
| Joint filing, few joint documents | Letter with a gap note; 2–4 strong affidavits |
| Divorce is final | Waiver letter, decree, personal statement, affidavits |
| Spouse has died | Waiver letter, death certificate, shared-life evidence |
| Abuse or extreme cruelty | Short factual letter; legal help for the statement |
| Filing late | Letter explaining the reason, with proof |
When none of these fit
A divorce that is filed but not final, or a spouse who refuses to sign, needs a different approach. The I-751 petition guide explains those bases.
Talk to an attorney too.
When Should You Ask a Lawyer to Review Your Letters?
Ask an immigration attorney or a DOJ-accredited representative to review your letters if you file an abuse or hardship waiver, have any arrest, file late, or got an RFE or NOID.
A short review costs far less than a denial.
Red flags that call for help
Any of these signs means a professional review is worth the cost:
- You are unsure which filing basis fits
- Your spouse is uncooperative or you fear them
- You lived apart for long periods
- You have past immigration violations
Finding affordable help
Nonprofit clinics often charge less than private firms; our guide to immigration lawyer costs compares options. Avoid notarios and anyone who promises approval.
Frequently Asked Questions
Who signs the cover letter for a joint I-751?
Both spouses should sign a joint cover letter, because both are petitioners on a joint Form I-751. Use the names exactly as they appear on the petition and the green card.
Can I write the affidavit for my friend to sign?
No. An affidavit is your friend's sworn testimony, so they must write it from their own memory. Drafting it yourself, or giving friends identical wording, makes the affidavits look unreliable and creates a false-statement risk.
Can an affiant live outside the United States?
Yes. The instructions ask for people with personal knowledge of your marriage, not U.S. residents. A writer abroad signs the original and can use a local notary or consular office.
Should the cover letter describe our wedding?
No. Wedding details belong in photos and affidavits. Keep the letter to the filing basis, the enclosure list and one short note on anything unusual.
Can I reuse the letter when I apply for citizenship?
No. Each filing needs its own letter. If you apply for naturalization while the I-751 is pending, USCIS must decide a pending I-751 before or at the same time as the N-400. Mention the pending I-751 receipt number in your N-400 citizenship application package so the officer can link the files.
Can the same people write affidavits for the I-751 and the earlier I-130?
Yes, if they still have first-hand knowledge. The rule is that affidavits from at least two people who have known you both since conditional residence began can support the I-751. Ask each writer for a fresh, signed original covering events since conditional residence began.
What if we move after mailing the I-751?
Moving does not call for a new cover letter, but you must notify USCIS within 10 days of moving while your I-751 is pending. Our change of address guide shows how.
What if my affiant made a mistake?
If the writer spots an error before you mail, they should sign a corrected original. Never edit a signed affidavit yourself; ask the writer to prepare and sign a new statement instead.
